pin_greyWhat is the difference between royalty-free music and licensed music?

Royalty-free refers to the right to use copyrighted material or intellectual property without the need to pay royalties or license fees for each use or per volume sold, or some time period of use or sales.

Music licensing is the licensed use of copyrighted music. It is intended to ensure that the owners of copyrights are compensated for certain uses of their work. A purchaser has limited rights to use and reproduce the recorded work without a separately arranged agreement.

A music Synchronization license, or “sync” for short, is a license granted by the holder of the copyright of a particular composition allowing the licensee to “sync” music with some kind of visual media output (film, TV Shows, ads, Video Games, accompanying website music, movie trailers, etc.). The rights to a composition or the “song”, which is different from the studio sound recording, are most often administered by the publishing company that represents the writer/producer.

What is a performing rights organization?

Performing rights organization (PRO) their fundamental job it is to keep track of every single performance or broadcast of all works protected under copyright.  The best-known of whom are ASCAP, BMI, and to a lesser extent SESAC (there are others as well).

pin_greyWho owns the copyrights?

O Face Productions owns all of the copyrights. We are letting you use the material for the price you purchase it for.  However, you can record vocals over a royalty free beat and copyright “your” song (vocals only).

Can I resell your stuff after I make a purchase?

No, you cannot resell our non-exclusive or royalty-free material.  We’re granting you permission to use “OUR” material in your productions.  If you purchase custom or exclusive music you can resell that because ownership is signed over to (you) the purchaser.  O Face Productions would be work for hire under this scenario.  We’d appreciate getting credit or a “shout out” for  being the production team behind those tracks!

pin_greyWhat is a Cue Sheet?

A cue sheet lists all of the musical elements of an audio/visual program.  Performing Rights Organizations like ASCAP & BMI use cue sheets to determine to whom it distributes performance royalties.
